Labelling requirements for packaging in Spain

From 1 January 2025, new requirements for labelling packaging that ends up as waste in private households will come into force in Spain. With the royal decree 1055/2022, this labelling of packaging will become a legal requirement for manufacturers and distributors.  

Labelling requirements as part of extended producer responsibility (EPR) 

Such labelling requirements for packaging have already been implemented in a number of other EU countries and are part of extended producer responsibility (EPR), which requires manufacturers and distributors of packaging to take responsibility for the recycling of their products and packaging even after they have been sold. 

What do the labelling requirements in Spain mean for obligated parties? 

From January 2025, manufacturers and distributors will be legally obliged to label all packaging clearly and visibly with pictograms. These pictograms indicate the correct disposal container in which the respective packaging components are to be disposed of. 

The reason for these labelling requirements for packaging in Spain is to ensure that end consumers separate the packaging materials better during disposal. This is one of many legally regulated measures aimed at increasing recycling rates in Spain. 

How can companies prepare for the labelling requirements in Spain?  

The mandatory labelling of packaging in Spain will apply from 1 January 2025. Packaging that was already placed on the market before this date may continue to be sold on the market. New packaging may no longer be distributed after 1 January 2025 without the specified labelling. 

Manufacturers and distributors should therefore start to look into the upcoming labelling requirements in Spain now in order to avoid the risk of sales bans.
